      The National Commission for Protection of Child Rights (NCPCR), in collaboration with MyGov, invites suggestions for the preparation of a Standard Operating Procedure (SOP) on the “Care and Protection of Children of Incarcerated Prisoners.”

      The SOP will be prepared with the objective of strengthening mechanisms for the identification, care, protection, rehabilitation, and overall welfare of children who are living with or are otherwise affected by the incarceration of their parents or guardians.

      The SOP seeks to ensure that the rights, safety, dignity, and best interests of such children are duly protected through a coordinated, child-sensitive, and holistic approach.

      NCPCR invites suggestions and inputs from stakeholders and citizens to help strengthen the proposed SOP and ensure effective mechanisms for the care, protection, and welfare of children affected by parental or guardian incarceration.

      A child whose parent or guardian is in prison shall be helped through the use of a child-focused case management process. All identified children can be referred to a case worker who coordinates with the Child Welfare Committee, District Child Protection Unit, school, health services, and all other relevant agencies. A separate electronic record of the child can be maintained in order to keep track of the progress of the child in regard to his/her education, health, nutrition, safety, emotional well-being, and eligibility for various welfare programs. Child-friendly assessment and review sessions need to be conducted along with immediate referral to address any issues related to child abuse, child trafficking, homelessness, dropout from schools, etc. This case management approach shall respect privacy, data protection, and best interests of the child.

      Parents shouldn't allow their children to walk alone outside. If necessary for child then they must focus that where the children are going. Parents also does not keep the home in the hands of their children alone because it lead to incarceration of children and compelling them for labour work in hazardous industry. Child always aware that not to talk anyone in the way and do not take anything from them. Child also remember about the child helpline number 1098 if they seem the condition of threaten from anyone.

      When a parent is imprisoned, their child also suffers a hidden punishment despite being innocent, facing stigma, insecurity and loss of care. The care and protection of children of incarcerated prisoners requires two approaches: for children up to 6 years living inside jail with their mothers, they must not be treated as prisoners - as directed by the Supreme Court in R.D. Upadhyay case, they need separate barracks, Anganwadi, proper food and healthcare, and their birth certificate should not mention jail. For children living outside, police must inform the Child Welfare Committee at the time of arrest, and the child should be placed with family with sponsorship support under Mission Vatsalya rather than in institutions. Every child has a right to meet their parent through child-friendly visits, continue education without stigma, and receive counseling, because the child has committed no crime and their best interest must come first.

      To ensure the holistic well-being, rights, and dignity of children of incarcerated parents, the best framework requires a coordinated, trauma-informed approach across policing, legal, and child welfare systems Mandatory Arrest-Stage Protocols: Require police to record details of dependent children during arrest memos. If no caregiver is available, immediately refer the child to the Child Welfare Committee (CWC) within 24 hours to prevent abandonment or trauma In-Prison Care (0–6 years): Provide specialized crèches, nutritious diets, vaccinations, and early childhood education within prison premises. Ensure birth certificates do not state "born in prison" to prevent lifelong social stigma Smooth Transition & Kinship Care: Prioritize placement with extended family or vetted foster care over institutionalization when a child turns six or if parents are incarcerated. Provide financial sponsorship to surrogate caregiver Preserving Parent-Child Bonds: Implement a "Child Connect" pro

The SOP should ensure regular monitoring, counselling, protection from stigma and discrimination, and coordination among child protection authorities.       further to my comments 9. the incarcerated child should be treated as a normal child and they should be trewated politly. 10. it will help them to realise and to convert as a good citizen' 11. may be by unknowingly they committed crime, one should keep it in mind 12. the SOP shall be prepared by keeping all above points in mind. 13. the SOP shall be prepared by all stake holders 14. the stake holders shall include jail authorities, police department, legal experts
