Why can’t we implement helmet rule?: Guj HC lashes out at govt

The Gujarat High Court pulled up state authorities and the traffic police department over the deteriorating traffic situation and poor road safety enforcement in Ahmedabad. It also raised severe concerns over non-compliance with helmet mandates, unchecked dumper trucks, and use of mobiles while driving. A bench of Chief Justice and Justice Nikhil Kariel, while hearing a PIL concerning traffic regulation and safety in the city, put up three important redressal points before government pleader G H Virk. During the proceedings, Justice Nikhil Kariel voiced strong displeasure over the non-enforcement of basic road safety mandates, questioning why helmet compliance remains virtually non-existent in the state. “From the previous orders, we note that you are doing the larger exercise of trying to find out the hotspots and risk analysis, but we are concerned about two or three basic things,” Justice Kariel remarked. “The basic aspect of helmets—these hotspots and risk analysis, everything is there; why cannot we have the helmet rule implemented? Probably we are the only outlier, and there’s no state in the country that doesn’t have helmet rule”. The court emphasised that other jurisdictions across India strictly enforce mandatory helmet laws for drivers and pillion riders. The bench shared that visiting dignitaries from other states express shock at absence of helmet enforcement in Gujarat. “When we have honourable judges from other states coming to Gujarat, they are shocked,” Justice Kariel observed. “We have been asked: ‘Don’t you have the helmet rule in your state?’” Full report on ahmedabadmirror.com
